1. The event
This Release of Liability, Assumption of Risk and Indemnity Agreement (“Agreement”) covers the private event named above, held at Kaizen Academy, 2014 Lincoln Blvd, Venice, CA 90291. In this Agreement, “Kaizen” means Kaizen Academy LLC, its owners, officers, instructors, employees, agents and volunteers, and the owner and landlord of the premises. “Participant” means me and every minor I list on this form.
2. This is a space rental. Kaizen does not supervise.
I understand that the event is a private rental of the facility, booked by the party host. Kaizen staff will open the facility, give the host a walkthrough, and close the facility at the end. No Kaizen staff will supervise, instruct, coach, referee, or monitor any Participant or activity during the event. Supervision of every minor is the responsibility of the party host and the parents, guardians and other adults attending. I will supervise the minors I list on this form, or make sure another responsible adult does.
3. Risks of the activities
Activities at the event may include running, tumbling, wrestling, grappling, games and horseplay on padded mats, and use of an inflatable bounce house. These activities carry inherent risks that cannot be removed without changing their nature, including:
- falls, collisions with other people, walls, doors or equipment, and being landed on;
- sprains, strains, dislocations, broken bones, cuts, bruises, and head, neck and spinal injuries, including concussion;
- risks particular to the bounce house, such as collisions between children of different sizes, falls inside or at the entrance, and deflation;
- skin infections, illness, and allergic reactions to food or other materials brought by guests;
- in rare cases, permanent disability or death.
I knowingly and voluntarily assume all of these risks, known and unknown, for myself and for each minor Participant, even if they arise from the ordinary negligence of Kaizen.
4. Release of liability
To the fullest extent allowed by law, I release, waive, and agree not to sue Kaizen for any claim, injury, illness, death, or loss of or damage to property arising from or related to the event or the use of the facility or bounce house, including claims caused in whole or in part by the ordinary negligence of Kaizen. This release does not apply to gross negligence or willful misconduct.
5. Signing for minors
I am the parent or legal guardian of each minor I list on this form and have the legal authority to sign for them. I sign this Agreement on their behalf as well as my own, and I agree that the release in section 4 applies to claims brought by them or on their behalf.
6. Indemnity
I agree to defend, indemnify and hold harmless Kaizen from any claim, cost or expense, including reasonable attorneys' fees, brought by me, by any minor I list, or by anyone else, arising from the conduct of me or those minors at the event, or from my failure to supervise them.
7. Bounce house rules
- The bounce house is for small children under 60 lbs only.
- An adult must watch the bounce house at all times while anyone is inside.
- No more than 4 children inside at once. Group children of similar size together.
- No adults inside. No shoes, glasses, jewelry, sharp objects, food, drinks, gum or toys.
- No flips, wrestling, climbing the walls, or hanging on the netting.
- If the bounce house loses air, everyone gets out immediately.
8. House rules
I will follow, and make sure the minors I list follow, Kaizen's house rules: no shoes on the mats, no food or drinks other than capped water on the mats, no glitter, confetti, silly string or face paint, nothing attached to walls, and no hitting the punching bags or touching any workout equipment. Kaizen will place a partition around the punching bags and workout equipment, and no one may go behind it or move it during the event.
9. Health and medical treatment
I confirm that each Participant is in good health and has no condition that makes these activities unsafe for them, other than what I've disclosed above. In an emergency, I authorize the party host, another adult at the event, or emergency responders to seek medical care for any minor I list, and I accept responsibility for the cost of that care.
10. Photos (optional)
Kaizen will only use photos or video of Participants from the event for its own website or social media if I opt in below. Opting out does not affect anyone's ability to attend.
11. Electronic signature and general terms
I agree that signing electronically is the same as signing by hand, and that Kaizen may keep this Agreement in electronic form. This Agreement is governed by California law. If any part of it is found unenforceable, the rest remains in effect. I have read this Agreement in full, I understand that I am giving up substantial legal rights, and I sign it voluntarily.
