Kaizen Academy ("Kaizen Academy," "we," "us," or "our") operates a martial arts training facility located at 2014 Lincoln Blvd, Venice, CA 90291, and the website trainatkaizen.com (the "Site"). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit our Site, contact us, or use our services, including Brazilian Jiu Jitsu, Muay Thai, and related programs.

Information you provide to us

Contact information — name, email address, phone number, and mailing address when you fill out a form, book a trial class, or sign up for a membership.
Membership and billing information — payment details, emergency contact information, and, for minors enrolled in kids programs, parent or guardian contact information. Payment card data is processed by our third-party payment processors and is not stored on our systems.
Health and safety information — injury history or physical limitations you voluntarily share with us so we can train you safely.
Communications — the contents of emails, text messages, phone calls, chat messages, and form submissions you send us.

Information collected automatically

Usage data — pages visited, time on page, referring URLs, and general interaction with the Site.
Device data — browser type, operating system, device type, and IP address.
Cookies and similar technologies — used for site functionality, analytics, and remembering preferences such as your light/dark theme choice. You can control cookies through your browser settings.

3. SMS and Phone Communications

SMS consent is never sold or shared. Phone numbers and SMS opt-in consent collected for text messaging purposes will not be shared with or sold to third parties or affiliates for their marketing purposes under any circumstances.

Consent

By providing your phone number through our website forms, in person, or by initiating a text conversation with us, you consent to receive text messages (SMS/MMS) and phone calls from Kaizen Academy regarding class scheduling, trial bookings, membership information, appointment reminders, and promotional offers. Consent to receive marketing messages is not a condition of purchasing any goods or services.

Message frequency and rates

Message frequency varies based on your interaction with us. Standard message and data rates may apply according to your mobile carrier plan.

Opting out

You may opt out of SMS communications at any time by replying STOP to any text message from us. After opting out, you will receive one final confirmation message. You can also reply HELP for assistance, or contact us directly at info@trainatkaizen.com or 424.299.1563. To opt out of phone calls, simply tell us during a call or contact us in writing.

Compliance

Our calling and texting practices are designed to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable CTIA messaging guidelines.

5. How We Share Information

We do not sell your personal information. We share personal information only with:

Service providers — companies that help us operate, such as payment processors, gym management software, form and email providers, and messaging platforms. These providers may only use your information to provide services to us.
Legal requirements — when required by law, subpoena, or court order, or to protect the rights, property, or safety of Kaizen Academy, our students, or others.
Business transfers — if Kaizen Academy is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

6. Children's Privacy

Our kids programs serve children ages 3–14. We collect information about minor students only from their parents or legal guardians — never directly from children. Our Site is not directed at children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child has provided us personal information through the Site, contact us at info@trainatkaizen.com and we will delete it.

7. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), gives you the following rights:

Right to know — request details about the personal information we have collected about you, including categories, sources, and purposes.
Right to delete — request deletion of personal information we hold about you, subject to certain exceptions.
Right to correct — request correction of inaccurate personal information.
Right to opt out of sale or sharing — we do not sell or share personal information as defined by the CCPA/CPRA, so there is nothing to opt out of.
Right to non-discrimination — we will never discriminate against you for exercising your privacy rights.

To exercise any of these rights, email info@trainatkaizen.com with the subject line "Privacy Request" or call 424.299.1563. We will verify your identity and respond within 45 days as required by law. You may also designate an authorized agent to make a request on your behalf.

8. Data Retention

We retain personal information for as long as needed to provide our services, comply with legal obligations (including tax and liability record requirements), resolve disputes, and enforce agreements. Former member records are retained in accordance with applicable statutes of limitation, after which they are securely deleted.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including secure third-party platforms for payments and member management. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Third-Party Links and Services

Our Site contains links to third-party websites, including our affiliated academies, social media platforms, and embedded services such as Google Maps. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party site you visit.

11. Do Not Track

Some browsers offer a "Do Not Track" signal. Because there is no industry standard for responding to these signals, our Site does not currently respond to them.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be communicated by prominent notice on the Site or by direct communication where required by law. Continued use of our Site or services after changes take effect constitutes acceptance of the revised policy.
